    First "insurrection" in history where they left their guns at home (in the worlds most heavily armed country), were escorted in by Capitol police, and just went home after a couple hours….all while waving the flag of the country they are supposedly "insurrecting" against.

    This is ridiculous. He wasn't anywhere near any protest. He was home ,i believe he was on the phone miles away telling people to be polite and calm. This what I have understood, end of story. Leave President Trump alone America needs him more than most people know or don't care bc of their personal interests. Thats obvious in my humble opinion.

    The correct answer is no. First off even though they use the word insurrection an awful lot he has actually not been charged nor convicted of insurrection by anyone check the court cases. And the second thing is even if all that wasn't true it still doesn't matter because the 14th amendment only applies to appointed positions in government not the ones that we the people vote for. The law was created so that southern senators after we reunified with the South couldn't appoint Confederate insurrectionist to government-appointed positions it has nothing to do with the ones we vote for

    Where Congress has failed to clarify Article 14 § 3 for the last 164 years, the standards and procedures for civil review are left to the states for administrative or judicial finding of facts in challenges to any candidate’s qualifications to hold office. The rights of all US citizens necessarily include the protections of § 3 that disqualifies election candidates who are proven to suffer a fatal defect in their qualification criteria. Electors pledged to an insurrectionist cannot be certified by the Secretaries of States, NARA nor the President of the Joint Session of Congress on 1/6/25. These common rights have now accrued by substantiated findings of fact in courts of jurisdiction notwithstanding a failure by Congress to invoke § 5. Appellants may not stay implementation of Article 14 § 3 protections where the state courts of jurisdiction and US House have upheld the factual finding of his insurrection instigation, which automatically triggers disqualification of any prospective elector who cannot swear both fidelity to DJT and an oath to support the Constitution

    Trump fomented insurrection for weeks prior to the attack. He promulgated and advertised insurrection. Trump held an insurrection rally the day of the attack, a stone's throw from the capitol. He verbally committed onsite to personally joining the attack. Trump gave aid, comfort, encouragement and reassurance to the attackers. Trump refused to intervene in the insurrection until it was clear the attack had failed. These are the facts and they are indisputable.

    SCOTUS must necessarily uphold the Article 10 state rights to regulate elections on appeal of the Colorado and Maine disqualifications. The Co. trial court and SCOCo. findings are well supported by "clear and convincing evidence" in a due process adjudication of the candidate qualification contest in both state courts of jurisdiction and that automatically disqualifies the DJT presidential electors given their “aid” as proxies to an insurrectionist disqualified from office by Article 14 § 3. The Maine Superior and Supreme courts must rule before SCOTUS, but all judicial review of that administrative decision must defer to the Maine Secretary of State if her factual findings are well supported, because she is the only one who is authorized to review candidate qualifications by state statute. SCOTUS may assist in resolving the facts on the matter in a federal challenge to the qualifications of the three Washington, D.C. presidential electors that must be adjudicated administratively by the DC Mayor, and then judicially before the DC trial court, and DC circuit court. The National Archivist and President of the Senate may be considered indispensable parties in these federal jurisdictions and then SCOTUS can refine the issues of law and fact considered for the entire national set of DJT electors along with the 3 D.C. electors and the DJT ballot appearances. A supermajority of 2/3 of both Houses is now required to remove the disqualification reached in Co. and Me., but the ORDERs are temporarily stayed pending appeal to SCOTUS.

    Trump has not been charged with insurrection, much less convicted. And no J6 person has been. Why? Because there was no insurrection. Despite the 24/7 media spewing of the word, legally it never occurred. An insurrection is an organized and armed conspiracy. J6 was neither a conspiracy or armed. It was a 2 hour crowd control event.
