Every homeowner gets to pay taxes on unrealized gains every single year to their state, its called real estate taxes.
If you are able to give our money away to other countries, we are over taxed..I hope this and others go through…gov needs to get their hands out of our wallets.
I would be shocked if the Supreme Court ruled against the Moore's in this case. There is NO Constitutional authority for Congress to tax Americans who haven't even received any money! The 16th Amendment did NOT permit Congress to lay a Direct unapportioned tax. A tax on your property or compensation is a Direct tax. According to the Supreme Court in Stanton vs Baltic Mining, the 16th Amendment conferred "NO new power of taxation." Can't get any more explicit than that!
No, the courts rarely make anything retroactive unless its the actual person that they are deciding on. Instead they almost always change the rule "going forward". But if they can tax this then why not tax unrealized increase in property valuation on your home, coin collection, cars, etc.
Soooo. The 16th amendment is a very dirty law that should’ve never been passed.
