    Ana and Cenk, your views on whether T** should be on the ballot, despite being constitutionally unqualified, miss a crucial point. Primary and general election voters should have the chance to vote for only legitimate candidates. It’s irresponsible to endorse the inclusion of a candidate who has violated the Constitution.

    Your support for primary leniency seems self-serving, as if you’re trying to secure a spot on a ballot for which you’re constitutionally ineligible. This stance sets a dangerous precedent, potentially undermining our electoral system. Such actions could pave the way for undemocratic candidates to exploit and possibly destroy the principles of U.S. democracy.

    To Quote the Secretary of State of Maine , “ Specifically, I find that the declaration of his (“T****”) candidate consent form is false because he is not qualified to hold the office of the President under Section Three of the Fourteenth Amendment.”

    I realize this is way late. I didn't watch the segment live and after I did I still wanted to digest Ana's opinion about the "political" aspect of the Colorado Supreme Court's ruling before commenting. My instinct was to disagree but I had to think about why. I now have; this is why the framing of the issue as "political" is wrong and concedes the decline of respect for the judiciary and the rule of law. First, Ana's reporting on the decision itself was, as usual, 100% accurate. Second, her assessment of the political fallout or inevitable criticism of the decision by the right is also understandable and perhaps inevitable. The incorrect part of the opinion was failure to frame the ruling as upholding the rule of law against those that see everything as political and therefore up for grabs. It is not political, it is an important constitutional-legal decision designed to protect democracy and ensure change through the democratic process; the very heart of the rule of law. Many journalists comment on legal matters without the substance that Ana presented because the legal weeds are too deep for a news segment. While important legal decisions may have political consequences are on occasion be influenced by the political views of the jurists, e.g. Dobbs, it is much more the exception than the rule. Acquiescing to the political framing further erodes trust in the rule of law that preserved our democracy during the last test, (60 court cases with several conservatives judges, Barr's refusal to support the plan, Pence, Liz Cheney, Kinzinger). Unless it is highlighted undiscerning viewers will begin to view every legal ruling as a purely political ruling akin to an impeachment, by 4 liberal judges. A horrible example of this trend is a law South Carolina just passed a law requiring judicial partisanship in elections.

    The reporting that certain legal scholars have found the provision is vague or ambiguous is about the same percentage as anti vax and anti climate-change scientists. Any English speaker will read it and ask, what's vague? The opinion of Ty Cobb on the provision is not an opinion anyone should rely on because he was a good trial lawyer. Trial lawyers are not necessarily legal scholars. The Colorado trial judge found that Trump's conduct did fit the terms of the insurrection clause and he committed an insurrection. The judge found however that the officer term did not apply to Trump because, in her erroneous opinion, the rules of interpretation required that the president and vice president be mentioned specifically. That is known as a non-sequitur, is an improper use of the consistency maxim, and was weird. The plain meaning rule which Cenk has mentioned many times, makes it clear that Trump is covered by the "officer" term. Another maxim of plain interpretation actually requires the opposite, that a specific exception to a general term must be stated if it is intended. The most important interpretive device is, of course the context and purpose of the provision. The civil war amendments were designed to right the wrongs that led to the war and prevent the schism that just happened. The obvious intent was to keep just such traitors out of the federal government. It is an unconscionable that every federal and state traitor is excluded except the president and vice president. Applying the constitution to people that violate it is not over-reach, it is required, like they said.

    The demagoguing by Trump and trumpists is inevitable and must not weigh against upholding the importance of the rule of law framing of every legal decision that is coming; there are many. Will right wingers want tit for tat? Of course but that Dan Patrick BS only plays in theory. Why was there not one case favoring Trump's lie? The rule of law. This is something that lay people think can easily happen. The rules that bind the court don't allow that level of activism. It reminds me of criticism of Kamala Harris for enforcing unpopular laws in California. There are guard rails and limits that prevent abuse of the judicial process. That's why Trump is desperate to delay the trials because he knows he will lose.

    I also disagree with Ryan Grimm. While depriving Trump of an election seems unsportsmanlike I doubt you would say that about Jefferson Davis being allowed to run against Lincoln right after the civil war and fill the federal government with his former confederate generals? Certain constitutional provisions are there for a reason, and must be applied when legally appropriate regardless of the political risk. The provisions are there to protect the Republic and our form of government. It's simple if you don't want to be disqualified don't attempt a coup. It's not about politics, it's about the rule of law and its centrality to our survival as a democracy.

I'm an Independent voter and every Independent voter I know is definitely voting and they're not voting Republican either. It's not Biden or any Anti Trumpers that will keep Trump off the ballot, it's the Constitution that will keep him off the ballot. People say, "Let the voters decide". Well, the voters have already decided in 2020, but Trump refuse to accept it and this is where it's ending up.     If it was ANY dem president attempting an insurrection NO ONE would question what the 14th Amendment meant. It would never even make it to court because the DNC would take it upon themselves to remove that person. What world are we living in? It's insane that he is elevated to level of a normal politician.     Colorado is predominantly Dem. Even if Trump were on their ballot, a majority of their voters would, based upon historical voting, vote Dem. Taking Trump off the ballot there will hurt the Colorado voters, who will feel disenfranchised, more than it will hurt Trump. Long-term, it will hurt the judicial institutions. Voters remember things. And … the rest of the nation is watching. This is going to raise Trump's popularity in the rest of the states, many of which are swing.

    Most people think that this is about Trump's desire to become president. That’s no longer his main motivation.

    Trump is facing 91 felony charges, including a Georgia state RICO charge and one accusing him of stealing classified information and lying about it. Even one felony charge is serious! He is not going to defeat all 91 charges. He couldn’t pardon himself for a Georgia RICO conviction. No federal prosecutor files charges against a wealthy former president without having good reason and feeling confident that they have evidence that will stand up in court.

    Boatright, the Colorado Chief Justice, is a registered Republican. All seven Colorado justices agreed that he engaged in an insurrection, but the three dissenting thought he should be convicted before being disqualified.

    All their reasons are explained in great detail in their ruling. Anyone taking the time to read it will understand that it wasn’t a political decision and why they ruled the way they did.

    Ive voted for Obama, Clinton, and trump in that order. I dont have party loyalty at all. And i can tell everyone that from a swing voter’s perspective that this attempt to bar Trump from the ballot makes all democrats look untrustworthy even after all the bullshit trump has done and said.

    This is not the strategy at least until there is a clear sedition conviction and after that conviction has gone through the appeals process.
