Trump was president until jan 12, so he was commiting insurrection against himself while he was president. Jack smith is not a special prosecuter. He was mot confirmed by the senate. Garland can't appoint a special prosecutor because the statute expired in 1999.

It’s obvious that Trump was involved in an insurrection but if you look at the law black and white considering how it can be used in the future, should he first be officially found guilty of insurrection in a court of law or just indicted ? The justices are not going to decide facts right ? but rather what constitutes insurrection officially
So would everyone indicted for storming the capitol be disqualified but what if they were there and not charged or just charged with trespassing ? Do they qualify to run for president ?

For me, it is very simple yet also easy. Trump should be put aside as a politician and comment on anything in the future about politics or sayings and action. This is very serious, his behavior is very disturbing. Democracy means not that one invites violence and threatens to retaliat, etc.
