Certain speech is not protected by the 1st Amendment. The Supreme Court has already ruled on this with Brandenburg v Ohio in 1969. The Court held that the government cannot punish inflammatory speech unless that speech is "directed to inciting or producing imminent lawless action and is likely to incite or produce such action". Not sure why I don’t hear this mentioned.
