    First everyone did not choose the cowardly insurrectionist, he did not win the majority of votes. Second trump lawyers and supporters argue for an imperial president while they contrive a fake impeachment of Pres Biden.

    We need to force congress, who represent us to change or remove all immunity for all offices or strictly limit immunity to only cover lawful acts related to their office.

    Democracy is not simply about the ability to choose an office holder (1:40). It is about everyone agreeing to, and following, the process of choosing office holders – AND holding all citizens to the restrictions outlined in that process. In short, we all agree to the same rules, we agree to follow those rules, and you can be punished for trying to break the rules. Does "Law and Order" ring a bell for anyone?

    So the document that gives birth to the powers of the presidency has no ability to restrain the person in that position? This is the opposite of the SCOTUS ruling in the independent state legislature case – that the state legislature must be bound by the document that authorizes their powers and limits. (Side note: Unless you are Clarence Thomas.)

    I know I’m a simple person but could someone answer a question for me? If trump did not swear an oath to support the Constitution of the United States, what was he doing on his Inauguration Day? I may be misremembering, but I thought each President, with their hand on the Bible, swear to support and uphold the Constitution. Did I hear that incorrectly? That no President swears after they are elected by, not the people, but by the Electoral College, to uphold that office and the Constitution. Could someone explain this to me in simple terms so that I can have a clear understanding of what 14.3 is saying and what trump’s lawyer is trying to say? Thank you.

    I heard the 14th ammendment also mantions "offers aid and comfort to insurrectionists"… 2 questions: 1. Trump not only offered aid and comfort, he keeps offering pardons in case he wins. Why is nobody using this argument? and 2. All the republicans that took an oath, and are supporting, offering aid and comfort to "now certified insurrectionist Trump"… Basically anyone who's part of the government and backs Trump is disqualified from ever holding office again. Trump should be like the plague and everyone should be running away from him. Why is it that no other republican is facing consequences for playing along with the big lie?

    So they are arguing that if someone is elected to high office and that person then commits insurrection because he hates to lose, then its ok because people voted for him, so in that case Richard Nixon should have been praised for his criminal activities while in office and encouraged to commit more crimes because the people voted him into to office to do whatever he wanted without restrictions, these maga folks are trying to invent a whole alternative constitution, one that gives a President the right to do anything he likes without retribution.

    An insurrection is what happened in Jan 6th and EVERYONE WAS GUILTY, PERHAPS IF WEPONS WERE NOT CARRIED IN AND USED ….MAYBE…MAYBE NOT AN INSURRECTION, BUT THEY DID CARRY WEPONS, THEY DID HAVE PEOPLE DIED BECAUSE OF IT, HOW CAN YOU CALL IT ANYTHING ELSE ?     Blocking a mailman would not be an insurrection. OMG these people are beyond ridiculous with these fantastic discussions pretending that this isn't a very obvious matter of law. The REASON someone who is not born of the US is not allowed to be President is because of loyalty — so a foreign king can not be put in power. And the REASON we don't allow an insurrectionist to hold office is because — they betrayed the office. They are a threat. They are a usurper. Trump is even suggesting he'd suspend the rule of law — just for a day — if he gets back in power. How many dog whistles does he need to blow?

    This is like some kid in high school writing a manifesto on how he's going to attack the school. We might not throw him immediately in prison, but, he's not going to be ignored I hope. Or become the principal.

    I'm sure this court decision that Trump is an "Un-Officer" will not apply to Biden if it ever comes up. What a "pull it out of your ass" decision. Why would you NOT have the 14th apply to POTUS? Did they just forget to think that a President would never be involved in an insurrection? "What are the odds?"

    Not a real fan of Arnold Schwarzenegger, but he saving grace is the that man KNOWS what and recognizes fascism is, and its dangers [first hand, his dad was a Nazi], and is vehemently opposed to it.
    As for the words "office" or "officer", it is plain that Trump once held the office of the President of the United States: the is NO difference between being appointed or voted into it. He took the oath, and was obliged to obey the US constitution. But he didn't. The treasonous insurrection is the disqualifying part, successful or not. The attempt is enough to disqualify him. He is not above the law, that is also plain and easy to understand. But if Trump is deemed "above the law", that would set a precedent for Biden to act as absolute monarch as well. Do these fascist fans even think?

    Looking at this from outside the USA it's clear to me that section 3 absolutely does apply in this case.

    It's debatable whether tump is actually disqualified under that section at this exact moment in time. However should he be found guilty in the upcoming criminal trial then there should be no question that he is from that point disqualified by that provision.

    The President isn't an officer? Even using it in the narrowest military sense, the Presdident is commander and chief of the U.S. Military. That makes him an officer by itself.

    He swore an Oath to support the Constitution when he became President. Therefore, he IS an officer of the United States, otherwise he would not sign paperwork identified as coming from "the office" of the President of the United States!
