NYS Senators Call on the Board of Elections to Exclude Insurrectionist Donald Trump From the 2024 Ballot

Sens. Krueger, Hoylman-Sigal & Others Say Former President’s Actions on January 6 Disqualify Him From Re-Election

NEW YORK — Yesterday, State Senators Brad Hoylman-Sigal (Manhattan-D/WFP) and Liz Krueger (Manhattan-D/WFP) led a letter urging the New York State Board of Elections (NYSBOE) to exclude Donald J. Trump from the New York presidential main and normal election poll below the Fourteenth Modification of the US Structure. The Colorado Supreme Courtroom is at the moment weighing a Fourteenth Modification problem to Trump’s poll eligibility.

Final 12 months, the Home of Representatives’ January 6 committee discovered that Trump “lit the hearth” of the violent January 6 rebellion. The Senators allege the previous president’s actions make him ineligible to carry workplace below the Fourteenth Modification’s requirement that no candidate can maintain workplace who swore an oath to uphold the Structure and subsequently “engaged in rebellion or rebel” in opposition to the US. This “Insurrectionist Disqualification Clause” due to this fact disqualifies Trump from the poll.

The letter, connected, states: “Having sworn an oath to help the Structure as an officer of the US, he then ‘engaged’ within the violent January 6 rebellion as that time period is outlined by regulation and precedent. Consequently, Trump is now ineligible to carry any ‘workplace . . . below the US,’ together with the presidency, until and till he’s relieved of that disqualification by two-thirds of each chambers of Congress.”

Together with the letter, Free Speech For Folks collected over 14,000 petition signatures from New Yorkers calling on the New York State Board of Elections to implement part 3 of the Fourteenth Modification and bar Trump from the 2024 New York presidential main poll and normal election poll.
