By my math (keep in mind , we lawyers don’t math), I think he only gets Rao, Katsas, and maybe Walker on the DC Circuit Court of Appeals, and Randolph is a wild card (he has a history as a constitutional scholar and has been on ethics and codes of conduct committees, but he’s also infamous for pulling a Clarence Thomas and failing to report gifts of trips and other things of value, and he’s really old (80) and a George HW Bush appointee, so it’s hard to know what he’ll do (does he care about his legacy or does he not because he knows it’s going to SCOTUS regardless), but either way, even if he gets all four of them, it’s still not enough to grant en banc review. We shall see…
