Trump knows that the only way he can avoid spending the rest of his life in jail is if he has absolute immunity from prosecution. But the only way he's going to get that is if he becomes a dictator; and the only way he's going to be dictator of the US is if he wins the next election, so he keeps arguing that he has immunity from prosecution in an attempt to buy time until the next election, when he hopes and preys that his gullible followers will vote for him. They will, of course, so we can only hope there won't be enough of them for him to win. But it really shouldn't even get as far as the election; he should be disqualified from running, and jailed, NOW.

Trumps empire of cards has been revealed, and none of his card empire is stable. Nebulous structures, Financial documents that can be described as questionable or shonky have been revealed.

I canāt help to feel that what I miss in most of all these talks about the phenomenon Trump, is some serious introspection into analyzing where did the American dream begin to corrupt the norms and values of a decent society so much, that a large number of people in this vast country choose to support an immoral, lying, cheating (be it on the golf course, in the board or the court room and in front of armies of tv cameraās) power-abusing narcissistic manā¦ā¦.? For your info: I am writing this from the other side of the globe, an old woman born just after WW2 in one of the West-European countries, now spending her last years in South Africa. not to be a Debbie Downer in this whole immunity argument but
The US government has conveyed substantial immunity from prosecution to its very members on the simple argument that as the government they would be sued for any and all imagined infractions on the Constitution (and personal religious and ethics) just to prevent them from taking official actions that would have a negative impact on the people, in the eyes of the people. For example we have income taxes today because Congress passed a law to establish federal tax. Without such immunity it would be a crime for the government to place a levy onto the income of the people even by an act of Congress. There would be a clear conflict between powers bestowed on Congress by the Constitution and criminal acts that violate state and federal law. So the concept of immunity for government officials is already widely established, and when the public files a civil case against such an action, the defendant is initially listed as "U.S. Government". Trump is in this case talking about absolute immunity which I guess would mean that he would never personally become a defendant (civil or criminal) if for example the US government were found to be acting in accordance with its Constitutional power but specific individuals in the government were acting in unconstitutional ways. Don't ask me the details about this but I'm fairly sure that this is common practice. Texas Governor currently springs to mind in terms of the "battle" that he's having currently with the Biden administration over the laying and cutting of barbed-wire along the Texas border with Mexico. So, official practice vs personal & private practice. This is the whole point of the "absolute immunity" argument, that there is NO authoity to charge the President himself for the actions of the President.
We can therefore imagine that Trump feels that the office is omnipotent if not the occupier of the office itself, and that the PResidency itself bears full responsibility for the actions of the PResident…and presumably their subordinates as well. I don't know. But with Trump, clearly the legal buck runneth nowhere near the executive branch. All credit, no blame? I'm not sure how exactly this would work out. Does this mean that impeachment and conviction are also off the table? I don't know. But yes the question is then raised, would President Trump ever be criminally or civilly liable for anything that he does once elected, even if it is done after he leaves office? (not getting into the "I didn't swear to support the Constitution" discussion. But the basic problem is that once "immunity" of any type, level or otherwise is granted to an official, they can then make the arguent that it is absolute. And to say that this does not make sense because of consequences is not a good argument against that.
As has been said many times, this is where the Constitution should be rewritten to make the answer clear. It shouldn't be up to a judge, even the Supreme Court, to fill-in the blanks of this issue. And what can of worms would that open. I think the problem here is that Trump can even make an argument for absolute immunity to be considered by a court. The court should simply rule on the question put before it, i.e. the constitutionality of his removal from the ballot by the relevant state official (who of course now the GOP wants to have impeached for doing it). The pure answer to the question is to have the justices evaluate that question on their own. If they are led to an answer by a political candidate or party, how ca they ever say that they have done so independently, with an open yet unbiased mind, and much as with everything Trump it just becomes another issue on which they can say that the Deep State has shafted the People's choice of candidate. The spinning of such a decision will be immense. This man can never be told that he is wrong because he refuses to accept the opinion of anyone who disagrees with him. Let's now make that national policy? Personally I think that this is exactly why that amendment was put into the Constitution, and for people to argue that it doesn't apply to Presidents is just insane. It was written FOR ELECTIONS, for the election of public officials. OK Putin would not need something like this, he would just have his people declare Trump to be an illegal candidate, and have him arrested and incarcerated indefinitely just as he has done with Nalvany.
The argument that Trump is making is the exact opposite. No member of the government would ever be subject to legal scrutiny. Forget about "executive privilege". But again I don't think the solution is to look at likely consequences. It should be clear in the relevant law.
If that is what we are dealing with…then make it clear. Otherwise invalidate the law for lack of clarity. Leaving the state to determine on its own who can run on its state ballot.
Trump would then have to deal with the fact that no one has a right to run for public office, no right to be on a state ballot. Separate the issue from the consequences. Or admit that the consequences are driving the issue…and that therefore we are not so much a nation of laws, but a nation of consequences, with the relation between consequences and the laws chosen by the Supreme Court. Or at least by District courts at the state and federal levels.
Anyway I would not say that his position is ludicrous. I'd say that it depends on what you think his position should be. One man's craziness is another mans' sanity, especially when it comes to the law…as our system of laws and rights is just a hash of presumed actions and implied consequences. If you take a consequence-driven approach to solving this, he would never qualify to be President again…but you'd have to grant immunity to whoever makes that decision…and even then I'd assume that they could still be impeached and convicted by Congress…I think that clearly you are dealing with a client and a bunch of lawyers who think they can game the American system of justice, which is what has them in this predicament in the first place. Maybe they're being coached by the Russians. Undoubtedly part of Trumps' core support and undoubtedly the justification used by the GOP to support him. "He doesn't do what he does because it is legally or politically correct, he does what he does because it's the right thing to do in response". Honor among thieves. "Actions have consequences". He's 77 years old. He doesn't need to wait until he turns 18 and moves out of the house to get back at his parents for punishing him for doing what he thinks is the right thing.
The question is "Mr. Trump if President Biden has you assassinated by Seal Team six, does he have absolute immunity?"
If only some of these titles were indicative of reality. Trump could become president again. And as long as he's allowed to run, you can take all of his supposed problems and toss them in the trash.
If I may, as a non-legal voice from the cheap seats, and regarding Pres. Obama: I completely agree that he was a marvelous person and an excellent President. I would also observe, however, that politics – especially here in the U.S. – is a hard-ball sport, and President Obama just didn't play enough hard-ball, or perhaps he had too much faith in the American electorate and therefore didn't use his bully pulpit as effectively as he could have or perhaps should have. Then again, back in 2015 no one saw the possibility of a Trump win, and the electorate just wasn't warned as it should have been about just how duplicitous and manipulative the Republicans can be (and are). Hence not enough voters saw through the choreographed disguise of Trump, plus too many Blue voters stayed home because they couldn't be bothered either way. Based on all that I've been reading about that time, and from my own recollections (I'm a retired Naval officer), I just don't think that Obama did all that he could have or should have to prepare the electorate for the 2016 election. Yet, having said all that, I miss him greatly.
