The law does not violate the PRIVILEGE of self-incrimination? The protection of the 5th Amendment against self incrimination is a RIGHT, not a PRIVILEGE!

How can you label a firearm an Assault Weapon when it has not assaulted Anyone ??? You Can however Label Abortion as a "Assault Weapon" because it has Assaulted a Person to the Point of DEATH !!! Abortions should Be Registered and Band !!! Why don't Abortionist have AOID cards ??? If you are not compelled or forced by law to submit an affidavit then depose the Gun Registrey and Ban as Law !!!

The state has also just moved this law into the territory of Ezell vs Chicago, which stands for the legal principle that a right now having a requirement to travel outside the jurisdiction to be exercised is a denied right.

Refuse to comply, this is an obvious unconstitutional law and no citizen should feel compelled to comply.

Love your updates, but can you cut out some of the nerdy fine grained detail and just get to the point. Especially reading every word from these legal filings. Just tell us the bottom line.

IL says 'government has no authority' to impose criminal penalty for not registering banned guns

Then why have a law mandating the registration!?

If you live in Crook County, they have their own gun ban in place too. Registering gives the county your information to come prosecute you despite complying with the state ban.

There may be no penalty for silence but there is a penalty for possession of an item formerly legally owned this "law" made hundreds of thousands of law abiding citizens effectively felons over night because feelings.

Bullshit they "haven't imposed economic penalty" on us gun owners. They've ran out 80% of all local non big chain FFL shops, there's not a single shop around that sells parts or firearms OF OUR CHOICE FOR PURCHASE IN THIS STATE. Not a SINGLE IL CITIZEN.

The title is misleading. The state argues that the government can't do anything to someone for simply not submitting an affidavit, and they give the example that an owner can choose to sell or destroy their property. So the state says that they can't do anything about the affidavit, but they assert that they can still prosecute for any possession. They're trying to divorce the two in order to weasel out from under the 5th amendment, explicitly claiming that it is not coercion and that there is no risk of prosecution — both of which are plainly false. Never take the word of a state lawyer that they won't do something harmful.

So let me get this straight. The state is arguing that the chances of your affidavit being used against you is "fanciful" and "not real or substantial". At the same time, we now know that they're planning on "closing the loophole", i.e. revoking the right to possess anything which would be named on the affidavit. Reliably dishonest as always.

But yet, Gov. Prickhead said in a press conference, that anyone who fails to comply with the unconstitutional registration requirements of their assault rifles and accessories, will have their FOID cards AND their driver’s licenses revoked. Why is this arrogant Prick still in office??? He’s a tyrant who’s violating the constitutional rights of Illinois citizens. A federal judge needs to issue an arrest warrant for treason and constitutional rights violations.

I'm still confused. If the IL govt holds a record oh who holds these weapons, then goes to confiscate said weapon, how would they know who held the weapon in the first place? It's almost like they already have a list of who has legally purchased these weapons. Why? Oh because of the Brady Bill, you are already tracked and checked against what type of firearm you are buying. It has to be, or it's not approved. So they already know what you have. Second, any additional firearm purchases, you make within a certain period of time, puts you on a "list". So now you are on two lists, for doing something, within your constitutional rights, yet still being tracked. Someone please tell me, because I cannot wrap my brain around the fact that IL citizens need to register a firearm for a 3rd time.

Everyone who owns a banned firearm and registers it is a confession of guilt of possession. It creates a confiscation list. PICA is an unconstitutional law, and the Illinois State government knows it. But democraps can do as they please. Democrap motto "good for thee, but NOT for me."

Nevermind the fact that if you didn't register your magazines that contain over 10 rounds or ar platform rifles/pistols/sbrs your facing a misdemeanor for the first offense and felony after the first. But hey. No pressure right?
