Gov/Smith on DC appeal suggests that criminal prosecution of a president doing his presidential duties can trigger a traditional criminal prosecution however, it cant. A president must first be impeached by house/Senate for crimes then criminally prosecuted. The gov can't skip over house/Senate impeachment proceedings or the prosecutorial legal process as per the Constitution.
