Impeachment is removal from office ONLY. Congress is a Legislative branch which is very much political and party bias. The opinion that a SETTING President can’t not be prosecuted is NOT a law, but a reasoned opinion in a DOJ memo. All impeachment service is attempt to remove a setting official from their position. In the case of the President or formal President is to no longer be the current President period. It doesn’t matter if he is impeached for unrelated or related acts or if 25th Amendment was acted or he resigned or he completed 2 terms or he lost reelection. Once he is no longer President he can be tried for crimes he committed while President NO ONE IS ABOVE THE LAW.

The courts don’t need to go too far to make any determinations about immunity and prosecution. See Nixon v Fitzgerald 1982, 457 US 731 regarding absolute immunity and the President as an officer. Clinton v Jones regarding acts committed before assuming the presidency. At the time of writing the 14th Amendment Morril and Johnson had quite a discussion about leaving the word President in the Amendment, in the end they made it apply to everyone in office, based on preserved documents discusing that issue. Judge Luttig discussed that the Vesting Clause of the Constitution which deals with the peaceful transfer of power disqualifies Trump from holding any office.
