Trump's "argument" is that the president can literally do anything to anyone he wants while in office and be immune from criminal prosecution. That's absurd, flouts the Rule of Law and goes against everything the Constitution outlines. He has NO real argument or excuse. He's the only defendant in criminal history to argue, not that he's innocent, but that he has the RIGHT to commit CRIMES. Think about that.
Voters DON'T have a right to "vote for the candidate of their choice". The candidates all have to meet Constitutional eligibility requirements. For example, I'd rather have Arnold Schwarzenegger as president than Trump, but I can't vote for him because the Constitution prohibits foreign-born presidents.
I don't trust this Supreme Court too much. However, it will be interesting to see what they say, because of the 6-3 conservative majority (engineered in part by dirty tricks in the Senate…). But the words of the 14th Amendment are clear and direct. Even if the SC Justices agree that it would be better for We the People to vote Trump down, they still have to deal with what the Constitution actually says.
Maybe the Republicans should work on amending the Constitution if they want Trump on the ballot.
Their defense is… he incited an insurrection, but…. He's was the president, so it's okay.
