An Appeal by Trump to the Supreme court in the Immunity ruling could be considered a "Red Herring". They know that case is lost in facts and in law but will likely pursue it to give the SCOTUS a boost of credibility when they vote to upheld it. One against (Colorado vote) and one in favor (Red Herring) to give the Court the leeway to decide favorably when the Big One comes in the form of Election claims after the vote.
