What is missed in this argument is that this is not specifically about Trump, but more about the Office of President. If Trump is provided immunity by order of court or no action from the courts law is enacted. The crux of the situation is that Trumps actions set precedence. If there is no punishment then any president past, current, or future is ok to act in the manner that he has. Given that, if I am Biden I am stating my intention to drive a stake in Trumps heart using similar tactics.

Republicans seem to misunderstand the essence of the 14th Amendment, Section 3. The primary intention behind its formulation was to prohibit individuals who incited the overthrow of the government from ever holding public office again. This provision is not inherently political; rather, it is a safeguard embedded in the U.S. Constitution's 14th Amendment Section 3. Consequently, we must adhere to this constitutional directive and refrain from allowing the return of figures akin to Jefferson Davis, including the controversial and divisive Trump, to foment influence within our government triggering a second American Civil War.

Section 5 of the 14th amendment's enforcement clause and the 10th amendment is enough for the supreme court to throw out this ruling.
10th amendment (as written) – “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” ( This says powers prohibited to the states, or powers delegated to the federal government specifically cannot be exercised by the state.)
14th sec 5 – "The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article." (This delegates the power to the federal government to enact the 14th)
All this is as it is written in the constitution, just look it up in the library of congress.

First Donald Trump was never convicted for insurrection on January 6th. And now we know the real truth it was all a setup from the deep state to deceive Americans stop Donald Trump. Undercover FBI agents started the riot. And it was not a planned attack. And the hidden speech of Donald Trump saying be peaceful respect the law and go home. Was hidden and was not shown to the public fake news and propaganda election interference. A violation of our constitutional of our God given rights to vote who we want in office. We Americans must fight this with all of our might. It has nothing to do with liking Donald Trump or want him in office. We fight this deep evil left to stop this once and for all so we can have a president that we vote for not because of what they try to plant in office

Wasn’t this case sent to Colorado Supreme Court by REPUBLICANS? Isn’t it REPUBLICANS that have given sworn testimonies to multiple grand juries against trump? His chief of staff, lawyers, advisers, his family? Seems they’re fed up with the “poor me” whining TOO 😂😂

FIRST Anyone who held federal and state office SECOND Swore an oath to support the Constitution THIRD then joined or aided in an insurrection FOURTH cannot or may not hold any federal or state office. THIS IS THE PENALTY. We cannot overlook the very ingredients that hold and bind us together. All men are created equal, and the law should apply to every person particularly where an oath has been sworn. Where an oath is distinctly sworn to THE OFFICE OF THE PRESIDENCY then to be, just and right, it must be penalized objectively. It cannot go unpunished. What can calmly and serenely help in this situation is sincere forgiveness; however, our nation may be subjected to repeated unnecessary harm. Think of the whole country; and the fact that, we are actors on the world stage of history. We are not a nation of Kangaroo courts never finding justice. GOD BLESS AMERICA

If there was no court proceedings back then when it was implemented to disqualify someone from running why should there be one now

Our Constitution stands. A former president caused an insurgency in the capital. Colorado is protecting the rights of the constitution. Other states should follow suit. He will be on the ballot because Colorado is a state and not our country. Who wins from corruption and money? But, we citizens have the last word vote, even if the rest of the candidates are not strong. Remember, Americans are one nation under God with justice for all. Trump and Biden should go to jail. Both parties are corrupt.

The house acted as prosecution and Trumps Lawyers acted as his defense. NOT GUILTY AND AQUITTED OF THE CHARGE . So what in the heck are you people even talking about .

The 14th Amendment is for non-elected, appointed office holders, and not for elected officials. There are other amendments that are used for elected officials… like impeaching and removing them from office.

The 14th Amd has major defects in it. Why? Passed after the Civil War. At least Congress provided a remedy. Amd needs to be amended.

Man these comments show how many (bots) and or actual people that’s ok with a dictator? I bet nobody can say he’s not guilty of the crimes that he’s being tried for? Nor is he he’s saying he had the right to commit the crimes because he was president at the time? You all said that Mike Pence could change the election? So I’ll expose the hypocrisy if Trump couldn’t be charged because he was president why do we what Biden to be lock up? Why are we for Hunter getting charged for evading tax payments when our orange god told us that made him smart? Why are we ok with a gun charge if we are pro 2nd amendment? I hope Trump is getting trolled in the polls the same way he is at his stump speeches!

The 14th amendment is pretty clear: Anyone who engaged in insurrection after previously taking an oath to the Constitution is disqualified from holding office again. Trump engaged in an insurrection on Jan. 6 2021 so he's disqualified from holding office again.

DJT received all due process warranted in a candidate qualification contest. DJT had a team of lawyers that ensured his due process at his disqualification trial that provided full briefing, witnesses and oral argument. His appeal was given fair consideration. Lawsuits challenging the qualifications of a candidate are always adjudicated by a state court judge without a jury. Both Colorado courts issued a declaratory judgment establishing DJT as a disqualified insurrectionist based on “clear and convincing evidence”. DJT is now banned from holding all government offices and none of his presidential electors can be recognized either, given they would render "aid or comfort" to an insurrectionist, which would violate Article 14 Section 3 as accomplices to the "dictator for a day".

Voters are asking for a clear definition of "insurrection or rebellion" as it appears in Article 14 Section 3. You'll know it when you see it, and in this case, it was DJT's attempt to displace his duly elected successor through extortion, bribery, fraud, vote tabulation interference and a deadly riot designed to prevent certification of valid Biden presidential electors in order to substitute a vote of states that would allow him to illegally retain his office. His actions were blatant felonies and violations of election procedures codified in Articles 2 and 12 of the US Constitution. DJT swore to "preserve, protect and defend" those laws and election procedures, and it is this arrogant abrogation of his oath of office that precludes his holding any new office.
