SC holds that non-disclosure of details of Electoral Bonds is unconstitutional as it is non-transparent and immune from RTI Act and violative of the Representation of the Peoples Act. It appears that SC has, in browbeating and terrorizing SBI, is being authoritarian and supercilious, intolerant of the normal course of the system and procedure and the maintenance of secrecy of bank clients, besides being unmindful of the lakhs of chronic pending cases in SC due to causes including apathy and lethargy and procedural procrastination. Keeping aside the legal validity of the SC's decision on the EBs as unconstitutional, the other relevant legal issues have not been given sufficient consideration by SC. The SC decision can only be prospective and not retrospective, that is why SC has not ordered return of the Bond funds to the Donors. The Order stops only future Bonds. Till the SC Order, the existing EB Scheme held good. The donors who purchased the Bonds, the political parties which received the donation, the Bank that issued the Bonds and everything else relating to EBs were governed wholly by the EB Scheme. After the SC Order, the political parties were not obliged to return the Bonds to the Donors. Similarly, the Bank is bound to keep utmost secrecy about the EBs, the Donors and the Political Parties under the EB Scheme. To coerce SBI to disclose the details of all past EBs legally valid till SC Order, is unlawful, aggressive and violative of the provisions of the EB Scheme which had legal force and validity till the SC Order. It is a breach of the sovereign guarantee to the donors and the bank under the EB Scheme. EB is not akin to the stolen assets sold to unsuspecting buyers or drug, liquor, corruption or contraband money passed on to the political parties or leaders, which are ab initio criminal gains. EB is legal gain under a legal sovereign scheme, valid till SC's Order. Present SC Order resonates with the Order in Golaknath Vs Punjab State and Keshavanand Bharathi Vs Kerala State on the unalterable fundamental architecture of the constitution. In recent decades SC relishes not only legal activism but exhibits high appetite for intrusion into and encroachment upon the executive functions. SC is not infallible. It is only final, disputable but not adjudicable further.

Every political party is getting money from corporates. Now BJP is rulling party so they are getting more money is quite obvious ! Getting money as donation through Electroal Bonds is completely different than Spending amount per candidate per election. Donation can be kept for longer time irresptive of elections.

Corrupt lawyer prashanth bhushan has not won anything and will never win. He is arguing for political donations in the form cash in gunny sacks instead of the transparent electoral bonds. Politics the world over is dependent on these contributions.
Political parties which collected donation either in cash or by EB in excess of the amount to be spent to the number of candidates contesting should surrender the amount to the public esquire or the EC should bar to that quantum of amount to be withdrawn for their election expenses.This will one way avoid illegal way of wooing voters.
