A presidential pardon is constitutional, and can only be made by a sitting president. That is THE LAW. That is why "presidents have immunity from suits", and that is THE SPIRIT OF THE LAW. That is why there is a term called "impeachment", that can only be done by Congress, that made the Constitution that embodies the PRESIDENTIAL IMMUNITY. You can file an impeachment case against a sitting president, which is a constitutional provision. But you cannot charge a sitting president in a court of law because of his immunity from suit. An impeachment from Congress can do. PERIOD.

What about the bigger question, of (1) is trump an insurrectionist relative to the 14th section C use of the term, (2) who determines that, (3) what forces (initiates the execution of) that determination, and (4) what final process should such a determination be made actually STOP Trump from taking power if he otherwise wins the election? For example, the SCOTUS says no, states can remove him from ballots, OR they say they can and some do….but he wins the general anyway!!! Can (will) a lawsuit then be filed arguing that he cannot take the oath because he is an insurrectionist, and can such lawsuit drive a process ending at the SCOTUS where a determination directly of the question at hand be made? Because right now it's all about "can states remove him from the ballot", which doesn't directly answer the questions of "is he an insurrectionist/should he be blocked from taking power?".
