Letting SCOTUS change this statute that the word "otherwise" to not mean "or" only will prove how feckless the Supreme Court has become. I actually think that former presidents will be immune from prosecution for official acts. Imagine George Bush senior attempting to run against Clinton again after losing the first time, analogous to what's happening now. Suppose the Clinton administration directed the DOJ to bring charges against Bush for crimes against humanity for kicking Saddam out of Kuwait. That's an official act for which I believe a former president should be immune from prosecution. Election interference, fomenting rebellion and so on are not official acts in my opinion, and a former president should not be immune from prosecution for them.
Because of questions like these, I can see why SCOTUS agreed to weigh in on the matter. I'll be most interested to see what they come up with.

Great analysis. Glad I came back to this hot take. Being that our democracy is on the chopping block it's easy to slam rulings without pause esp with the likes of cannon. Tho I believe Alitto and Thomas are corrupt, Roberts and Kavanaugh untrustworthy it is possible the scotus will rule with precision disallowing absolute immunity for the sake of our country. But I won't hold my breath for it.

Here is how I expect it to play out. The Supreme Court finds that presidents have immunity for official acts, they retain that immunity after they leave office, and remand the case back to the trial court to determine if Trump's acts on Jan 6th were "Official Acts". The Trial court will find they are not. Trump will appeal and the Appeals Court will uphold the trial court. Trump will appeal that ruling to the Supreme Court, but even if the Supreme Court denies the appeal, it will push the trial back too much to be held before the election.
Honestly, it is likely the right way to handle the case. If a President loses immunity for official acts when he leaves office, you have a mess… For example, Obama could face murder charges for the deaths of Osama Bin Laden's wives.

I'd like to believe that SCOTUS will do the right thing, but all they had to do was not take up the case. If they really felt the need for clarification, ok. Hear arguments next week and hand down a decision within a week. The delay screams intent.

Now what's more likely ….? Several times a day you come tell us the news we want to hear, but he's not in jail and he's winning every delay move he played. You have to face the fact that you not only not have a functioning democracy, you don't even have a functioning legal system. Most votes don't count, and you can endlessly postpone your case all the way into a corrupt supreme court. The coming election will be your last free ones and then China and Russia can point to you and say "see, that democracy thing doesnt work at all". Putin and Xi have already won.
