    To clarify, the Constitution is explicit in its provisions. The Supreme Court of the United States (SCOTUS) is constitutionally mandated to always make decisions that are deemed 100% correct within the framework of constitutional law. This authority supersedes any constitutional amendment. If Congress suspects malicious intent, it has the legal right to impeach without needing to provide a specific reason. As long as the impeachment process is successful, it is an established fact that a justice can be removed from their position. There are balancing forces in place for every branch of the government, including SCOTUS. Legally, SCOTUS's decisions are always correct, regardless of the circumstances. Additionally, it is a fact that Congress has the power to impeach a justice. The criticism from Democrats stems from the current polarized political climate of left versus right, coupled with their lack of power to dominate unilaterally.

    The constitution is clear Donald Trump should not be on the ballot, however states should decide. In addition if the concerns are about individuals not being able to vote for a candidate of their choice each state has a method or provision for "write in" candidate on each ballot. This is an off ramp that the court should consider.

    The 6th of January was not an insurrection. An insurrection would be much worse than just a protest. This was simply a protest. I've been through the LA riots and portland riots if that had taken place at hhe capital that would be sn insurrection. There were no weapons and no military coup just a simple protest.

    I find it hard to believe SCOTUS will say the government has the power to just declare anyone they feel like a traitor barred from running for any public office without due process

    SCOTUS’s ruling will probably say Trump deserves his day in court to defend himself before he can be barred

    Doesn't Trump have to be tried and convicted of insurrection by a legal court before being considered an insurrectionist? A transfer of the presidency did take place according to the legal process.

    I am always amazed at this. I am 77 years old and have seen many insurrections in other nations. In every case hard men with guns stormed the places of power and through force of arms killed or jailed the former leaders and took power. Never have I saw a group with cameras break into a place of power and then just leave. Not one person has been charged and convicted for the offense of committing an insurrection. Plus, article 5 of the 14 th amendment says that the congress will remedy by passing appropriate legislation. Nowhere in article 3of the 14th amendment is it said it is self executing.

    I am not a lawyer but in reading the 14th Amendment Section 3, is clear. Any person who holds office in the government and is in a coup cannot ever hold any office in the country.
    WHAT IS NOT TO UNDERSTAND?

    He’s absolutely right in his constitutional judgment regarding the clause and I hope the Trump selected Supreme Court justices will not be beholden to Trump and recuse themselves.
