    It almost sounds like the Supreme Court has been bought and paid for by the Democratic Party because they hate Trump and apparently the Supreme Court hates Trump. There’s so much hate against this man since day one and it still has not stopped. Isn’t it time Supreme Court that you stopped this hate and let him be free to be the man God met him to be did not God put you in this perspective of being a Supreme Court justice system then do your job and do it right Stop playing games because because you’ve been bought paid for by the Democratic Party out of their their hate for American people and the Republican party that is true Republicans.     If the Supreme Court screws this one up I don’t think it will end well for the nation. We are as divided as I have ever seen in my lifetime. The right for the most part have been willing to work within our laws to find relief. But we have already lost our confidence in the Executive branch. Look at the polls. We have lost our confidence in our legislative branch. Again the polls are in the basement on approval. If we completely lose our confidence in the judicial branch? What’s left? We already have certain judicial jurisdictions that are obviously politically biased. (Like Denver) We will be a 3rd world country where our candidates are hand picked by the elites.
    I don’t believe half the nation will be ok with our freedom to choose our candidate being taken away from us.

    We do not have a right to vote for the candidate of our choice. We have a right to vote. Candidates are disqualified all the time. Colorado has dealt with plenty and has done so in exactly the same way. There was nothing unilateral about the Colorado decision. It was referred to the Denver District Court, as always, and a trial was held. From there we know the story. The SCOTUS was fine with letting each state define its own abortion laws so why would this be any different? I predict the SCOTUS will rule 9-0 against Trump. The guiding political and societal rationale will come from Brown vs Board of Education. The GOP just needs to move on and find a different candidate. How hard is that?

    Doesn’t the jurisdiction for this question lie with the US Congress? Amendment 14, Section 5 states: “The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.”

    Has Congress passed legislation regarding insurrection? Yes, they have. Title 18 USC 2383 – Rebellion or Insurrection. Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States. Since President Trump has not been charged and convicted of this crime, he cannot be barred from running for office.

    Trump was impeached for inciting an insurrection by the House of Representatives. He was not convicted and removed from office by the Senate. President Trump was still in office at the time the so called incident took place, so criminal charges could not be levied under the aforementioned title. The impeachment process was the appropriate jurisdiction for these charges. Had the Senate found him guilty and removed him from office, then he could be prosecuted criminally and prohibited from running for office. Even then, Congress can waive that prohibition by an Act of Congress. No conviction, no bar to run for office.

    I’m not a lawyer, and I didn’t stay at a Holiday Inn last night, but that’s what I would say to the Court. Since the Court has never heard this issue before, I would subscribe to the KISS principle…Keep It Simple Stupid. Keep them focused on the appropriate jurisdiction being Congress, not 50 state level supreme courts. Even if you think his alleged conduct rises to the level of insurrection, which I would argue it does not, it’s still appropriate for Congress to deal with it through impeachment first, then the criminal Courts upon conviction and removal from office.

    The closest analogue to this is President Nixon. He resigned when he was told he would be convicted and removed from office if he was impeached. President Ford pardoned Nixon, so the country could move on, and as a result, the question of whether he could be prosecuted for his alleged conduct while in office would not need to be considered. President Clinton was impeached, but was not removed from office. I do not believe any DA filed criminal charges against him after he left office, though I believe he lost his BAR card for a while.

    Is there a link to the various briefs? I’m curious to see if anyone made similar arguments to what I’ve written.
