The 14th amendment was written after the Civil War and was particularly written to make sure that all of those individuals in the south who attempted to overthrow the United States could not be elected. None of those people had been members of Congress, Senate or the president. Committing insurrection is committee insurrection.

Maybe it was so long ago and I am remembering my oath wrong, but I couldâve sworn that when I joined the military, our oath was to support and defend the constitution of the United States against foreign and domestic enemies. I canât imagine that the military is required to stand by that oath, yet the president isnât.

Oh, and Independents? No, both sides are NOT anywhere NEAR the same. Just take a few minutes of time to look over the voting history of those in Congress. Pick ANY bill or law you might be curious about, one that would or did do a lot of good, and see who voted for it and who voted against it.
You will notice that, overwhelmingly, it was the Ds and Is that voted FOR something helpful, and AGAINST anything harmful, to the regular person. It will be the former GOP (currently the GQP) who voted Yes on bills that hurt us & helped the rich, while voting No on anything that might insult their CEO caretakers and help us regular schmoes. Every time!

The 14th Amendment to the U.S. Constitution, ratified in 1868, granted citizenship to all persons born or naturalized in the United Statesâincluding formerly enslaved peopleâand guaranteed all citizens âequal protection of the laws.â One of three amendments passed during the Reconstruction era to abolish slavery and establish civil and legal rights for Black Americans, it became the basis for many landmark Supreme Court decisions over the years.
In its later sections, the 14th Amendment authorized the federal government to punish states that violated or abridged their citizensâ right to vote by proportionally reducing the statesâ representation in Congress, and mandated that anyone who âengaged in insurrectionâ against the United States could not hold civil, military or elected office (without the approval of two-thirds of the House and Senate).
It also upheld the national debt, but exempted federal and state governments from paying any debts incurred by the former Confederate states
Section Three: 14th Amendment
Section Three of the amendment, gave Congress the authority to bar public officials, who took an oath of allegiance to the U.S. Constitution, from holding office if they "engaged in insurrection or rebellion" against the Constitution. The intent was to prevent the president from allowing former leaders of the Confederacy to regain power within the U.S. government after securing a presidential pardon. It states that a two-thirds majority vote in Congress is required to allow public officials who had engaged in rebellion to regain the rights of American citizenship and hold government or military office.
It states that: "No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof."

"The Evil In The World"
When I was 17 I had been living homeless and on the streets of Downtown Houston since I was 8 years old. Evil was a part of life on those streets. I saw so many lose their lives in all sorts of Evil ways. I thought I knew what Evil looked like. The very day I turned 17 I was on a bus headed for basic training in Fort Polk Louisiana. 3 hots and a cot looked very appealing to me at that point in my life, and they paid you. Not much, $417.20 a month, but I was happy to be out of that Evil hell hole I grew up in. After training, I was sent to Germany. I arrived in Berlin in 1976. The height of The Cold War. At that time both sides were calling the other the Evil in the World so I didn't know what to expect. Was I one of the good guys or one of the bad? I didn't know. From the Airport in Berlin we were taken to Check Point Charlie to see what it was we were there for. I was shocked at what I saw. I thought I knew what Evil was but after only a millesecond of looking at that Wall and what was on the other side of it I realized I knew nothing of Evil. I was on the right side of good and Evil. I could see it and I felt it to my bones. What I was looking at was the Evil in the World. Communism. This is the Evil in the World. I was from then on proud to stand with arms against that Evil. I guarded that Iron Curtain from Berlin to what was then Czechoslovakia, and that same Evil was everywhere I saw. There is still no doubt in me what Evil is. I saw it with my own eyes. Sadly. I now am seeing this same Evil here in America. Most of the Republican Party are now trying to bring that same Evil to America. All this with Trump and friends has been a Communist attempt to pull off a coup to destroy Our Democracy and install a Dictator using Trump and friends to do so. Make no mistake. Most of the Republican Party have traded their Oaths of Office to Uphold and Defend Our Constitution and the Rule of Law for an Oath of Loyalty to a Man and a Party. They are now Communist intent on destroying Our Democracy. If we are still a Country that Upholds and Defends Our Constitution and the Rule of Law, everyone who participated in this Communist attempt to takeover of Our Government must be put out of Office under Section 3 of the 14th Amendment, and never be allowed to run for or hold any Office ever again. Trump and his would be Communist Dictator Installing Traitors must go to prison for their treachery against Our Constitution. Put them all in a cell all around Trump so they can admire and kiss the hooves of their Golden Calf, from in there. May God help us and forgive us for ever letting this Evil come into his Country. This should be treated as an act of War on the United States from Russia. Putin is behind all this. America must reject the Evil of Communism, lest we become the Evil in the World. A perfect example of Our Constitution that is self executing is, if you are born in the United States, you are a American Citizen. You don't have to have an act of Congress for this to take effect, you don't have to go to the Courts to decide the issue. If you are born in the United States, you are automatically an American Citizen. Section 3 of the 14th Amendment is just as self executing.

The US Supreme Court is corrupt. They don't want to take Trump off the ballot. They are trying to find a way to get around it. Even look at how long this immunity case is going. Why is it taking so long? It seems like someone sent a message to those three judges to wait so that Trump can get away with it. But the US Supreme Court could have handled this long ago taking on Jack Smith's case and ruling legally lawfully judicially on the case to say that Trump committed insurrection and he should be off the ballot. But they're not doing that. They are abiding their time to the point where it's too late. They are being political not judicial. Such is corruption in the USA.
As an outsider, I fear that should Trump be elected changes will be enacted that will see his death being the only way that he'll be removed him from the seat of power in the US. Is this bigger than Donald Trump – is the Republican Party trying to move from US style democracy toward authoritarian politics? There are signs that Trump is loosing his grip on reality – he may not be in control here.

I share the position that the Rule of Law takes push over politics. Meaning, the legal questions are to be settled in court(s) and not handed to voters.
Mr Trump had his chances at the ballot box and his chance to peacefully transfer power to the winner of the 2020 election. He chose violence over the law, the legal system and the constitution.
Laws and our legal system exist to settle disagreements without violence.
The former president committed insurrection by choosing to ignore rulings of federal courts in the 61 cases his lawyers brought in Nov to Dec 2020 after the election, suggesting concern over fraud. 60 cases were dismissed for lack of any evidence brought by those lawyers (Giuliani, Powell, Ellis, et al). One case changed the vote count by a tiny amount – in favor of the winner, Joe Biden.
The former President had many many dozens of enablers to attempt to overthrow the 2020 election result. Some of them have pled guilty in court (Chesbro, Powell, Ellis, et al).
The many other enables in Congress and the Senate should have any applicable charges brought against them, too, after the DC & GA cases against Trump are ruled on.
The best summary out there. It does not get better than this.
If Trump really believes that he won the 2020 election, he CAN'T run a third time.
My prediction is SCOTUS will strike down this Colorado decision under the following justification. The 14th amendment section 3 gives power to prevent someone from taking office, however it does not give States the jurisdiction to remove people from a ballot.
